  • When a marriage ends, dividing property often includes retirement savings such as 401(k) plans, pensions, or other employer-based retirement accounts. These assets can be among the most valuable in a divorce, and dividing them properly requires more than just an agreement between spouses.

    In Illinois, if your divorce involves a qualified retirement plan, you’ll need a separate court order called a Qualified Domestic Relations Order (QDRO).

Military Retirement Division | Consulting & Services

Military pension division is not a standard QDRO. It runs on its own statutory framework — the Uniformed Services Former Spouses' Protection Act (10 U.S.C. § 1408) — with its own rules on what's divisible, how the marital share is calculated, how disability compensation interacts with retired pay, and how the Survivor Benefit Plan has to be elected to actually reach a former spouse. Get any of it wrong and the Defense Finance and Accounting Service (DFAS) rejects the order, or the former spouse ends up with a share that evaporates when the member waives retired pay for VA disability.

There is a real shortage of attorneys who do this work correctly. Most divorce practitioners handle one or two military cases a year and treat them like any other pension split. They shouldn't.
